ROAD RIDER DIVISION OF AMERICAN MOTORCYCLIST ASSOCIATION DISTRICT 36, INC

BYLAWS

ARTICLE I

This organization shall be known as ROAD RIDER DIVISION OF THE AMERICAN MOTORCYCLIST ASSOCIATION, DISTRICT 36, INC. hereafter referred to as “The District" or “District 36”, a not-for-profit organization, comprised of American Motorcyclist Association District 36 chartered clubs and promoters, hereafter referred to as “Organizations” and individual members within District 36 of the American Motorcyclist Association.

ARTICLE II

The purpose of The District is to promote the Road Rider aspect of motorcycling for the enjoyment of its members through closer cooperation and communication of District 36 Organizations, individuals, AMA headquarters and their representatives and other motorcycle organizations.

ARTICLE III

The elected officers of District 36 shall be President, Vice President, Secretary, Treasurer, and Sergeant-at-Arms. These officers shall comprise the Executive Board and shall hold current AMA membership cards. No two members of one family, nor more than two members of any Organization, shall hold a District level voting office or position simultaneously. No elected officer of The District shall hold more than one elected position at a given time.

ARTICLE IV

The President's duties shall be to preside over all meetings of the District and the Executive Board, to appoint up to four Referees, Social Secretary, Risk Management Officer, and other officers as deemed appropriate; to appoint special committees; to have general supervision of the affairs of The District; to vote only when necessary to break a tie at an Executive Board or Delegates meeting. All appointments shall be subject to approval by the District Delegates.

Regardless of the term of office held, the President shall only hold two consecutive terms of office.

ARTICLE V

The Vice-President's duties shall be to assist the President at his or her request or at the direction of The District; to assume charge of meetings and other affairs in the President's absence. Vice Presidential duties also include the publication of District fundraisers such as the Awards Banquet Gypsy Tour, Hey Dey and the Turkey Run.

ARTICLE VI

The Secretary's duties shall be to keep a record of the meetings of The District and the Executive Board; to send out notices of meetings; to perform form all District 36 correspondence; and other duties which fall to this office.

ARTICLE VII

The Treasurer's duties shall be to collect all money due The District; to properly protect all District 36 money; to submit a Treasurer's report at all Executive Board and Delegates meetings and upon request of the President or Executive Board; to make all payments, by check, from District 36 funds, when directed by The District; to furnish adequate bond at the request of the Executive Board and/or Delegates, for an amount to be determined by the Executive Board and to be reimbursed by The District. The Treasurer is also responsible for the yearly filing of Franchise Tax Board form 199N and Internal Revenue Service form 990N.

ARTICLE VIII The Sergeant-at-Arms duties shall be to maintain order at all general meetings of The District; to collect all fines levied by the President or officer acting in the President's behalf, if objection is raised by the fined party, the fine shall be subject to a vote of the Delegates.

ARTICLE IX (This article is suspended due to AMA National deleting Road Representation at the Annual Congress)

The duties of the AMA Congress Delegates shall be to act as a central point to gather and disseminate all pertinent information, both from the AMA to its membership and from its members back to AMA; to function as a liaison between the AMA and The District, particularly in the areas of public relations and legislation; to work as a bonding factor for The District, doing everything possible to keep The District together; to communicate with other AMA Congress Delegates; to encourage organizations to work together instead of competing.

ARTICLE X

The duties of the Referee(s) shall be to advise the Executive Board on various contest rules and advise each organization Referee on contest policy on both District 36 and AMA level rules. He or she shall assist in formulating and est- ablishing fair contest rules, assist the Executive Board, and make recommendations on any protests filed.

ARTICLE XI The Risk Management Officer shall (a) complete and pass the AMA Risk Management Training Program, ( b) in the event of an accident complete an accident incident report and forward this form to AMA headquarters within 24 hours.

ARTICLE XII

The Social Secretary's duties shall be to maintain records of the activity point system; to assist the Secretary with correspondence when necessary and conduct informational seminars as required.

ARTICLE XIII

The Publicity Officer shall create, advertise, publicize and distribute information regarding District 36 events, such as Awards Banquet, Gypsy Tour, Hey Dey, Turkey Run, charity events, and Chartered Club Organization events. Publish and distribute that information through flyers and/or electronic media. Other duties include updating the District 36 web site monthly. In the event this position is not filled, the Vice President shall assume the responsibilities of Publicity Officer.

ARTICLE XIV

The Parliamentarian's duties shall be to ascertain that meetings are conducted according to Roberts Rules of Order, unless otherwise provided for in the By-Laws.

ARTICLE XV

Individual members of The District shall be represented by Individual Rider Representatives. These representatives shall be current members of AMA, but not affiliated with any AMA chartered or non AMA local organization. Individual Rider Representatives shall be confirmed by vote of the member Delegates

Upon receipt of an application letter and signed petition, with the names, addresses and county of residence of not less than five current AMA members who are not also members of any AMA chartered or non AMA local organization. The petition signers shall reside in the same county as the applicant. The petition shall include the AMA number and expiration date of the signer, and a statement to the effect they wish to authorize the applicant for the office to speak and vote on their behalf at all general meetings. These officers shall reapply for confirmation on an annual basis, just as all other elective offices are voted on an annual basis. There shall be no more than one Individual Rider Representative from any county within District 36.

ARTICLE XVI

The five elected officers of District 36 shall comprise the Executive Board, and a quorum of three members must be present before any meeting may be held Their duties shall be to meet previous to each meeting of The District to discuss affairs and attempt to resolve questions and submit recommendations to The District; to submit a report of the Board meeting to The District at the next regular meeting; to appoint an auditor and verify the audit of the Treasurer's books at the end of each fiscal year; to have general control over all District 36 affairs. The Executive Board, except in emergency, shall not appropriate money and shall not authorize payment of bills except with approval of The District upon recommendation by the Board. All checks shall require two signatures. Those authorized to sign checks shall be the President, Vice-President, Secretary and Treasurer.

When there are multiple persons from the same Organization who are authorized to sign checks under the Bylaws, no two signatories can be from the same organization. Where time is a factor, Action Authority Approval shall be assumed by the Board to act on behalf of The District, providing each case is reported to The District at the next meeting for final approval.

ARTICLE XVII

The District 36 fiscal year shall be based upon the calendar year.

ARTICLE XVIII

Membership in District 36 shall be open to any AMA chartered club that is in good standing, by applying in writing to the District President, and by sending representatives to a Delegates meeting where they are approved by a two-thirds (2/3) majority of members present. The following information shall accompany the application: 1. Organization name and AMA charter number. 2. List of officers telephone numbers, including main contact for AMA business. 3. Mailing address. 4. Meeting place, address, time and date. 5. An agreement to abide by the By-Laws, rules and decisions of the District. 6. Payment of annual dues as set forth in the By-Laws. (See Article XXII)

ARTICLE XIX

Nominations for all elective offices shall be held at the July meeting each year. At the next regular meeting, nominations may be reopened if requested, and the Election of officers, except Congress Representatives, shall be held at the Calendar Bidding meetings. All persons, properly nominated shall be present at the time of nominations unless the nominee submits in writing to the Executive Board, their intention to run for office. The nominee may also notify two (2) members who are willing to relay the nominees intention at the next Delegates meeting. All newly elected officers and appointed officers shall assume and hold office for one year, commencing with January 1. All elections shall be by secret ballot.

All persons properly nominated shall be voted upon even if prior votes show two winners from the same Organization. The winning office holders will get to choose which office, if any, they will accept, so long as the By Laws are not violated. Re-voting, but not re-nominations, will occur if the winner of an office declines that office.

The President shall appoint a committee to count the ballots and prepare an election report. No nominee is to serve on this committee. Elections shall be declared official at the time of the announcement of the results. In the event an elective office is vacated during the year, such elective office shall be filled by a temporary appointment by the Executive Board, and nominations for the office shall be made at the same meeting. An election shall be held at the following meeting, with seating of the new officer at that same meeting.

ARTICLE XX

The regular meetings of The District shall be held every odd numbered month, at a location and on a date designated by the President. Special meetings may be called as required and shall be conducted as regular business meetings. All member Organizations and Individual Rider Representatives shall be notified of a special' meeting in sufficient time to permit their attendance. The Executive Board shall meet previous to the District meeting, at a location and on a date of their choosing. (Odd numbered months: JAN, MAR, MAY, JULY, SEPT, NOV)

District 36 is comprised of two (2) members appointed by their Chartered Club. No more than one (1) Individual Rider Representative per county also attend Delegate meetings, both have full voting rights, shall make or second motions, make nominations, or otherwise take part in the regular business of The District. Only in case of a tie shall the President cast a vote that shall be a tie breaker vote.

All voting and non-voting officers, Delegates and Individual Rider Representatives shall hold a current AMA card, shall be required to sign in at all meetings, and vocally answer when role is called to be readily recognized during the transaction of other business. An Individual Rider Representative may request an alternate to act in his or her absence with proper notification to the President prior to the meeting.

A quorum shall consist of those Delegates and Individual Rider Representatives present at any regular or special meeting of The District. A simple majority of eligible voters present shall carry any motion, except amendments or additions to the Bylaws.

ARTICLE XXI

THE ORDER OF BUSINESS AT DISTRICT 36 MEETINGS SHALL BE: 1. ROLL CALL 2. INTRODUCTION OF GUESTS 3. READING OF PREVIOUS MEETING MINUTES 4. TREASURER'S REPORT AND SUBMISSION OF BILLS 5. ARTICLE XXII

Member Organizations shall pay a Thirty Five Dollar ($35.00) annual dues fee per calendar year, per Organization, payable on or before the National Sanction meeting. Annual dues shall not be prorated. Should an Organization fail to pay their dues, their Delegates shall not be permitted to vote on any District 36 business until the dues are paid.

ARTICLE XXIII

Any complaints of misconduct against a member Organization or individual member shall be made in writing to the Executive Board within thirty (30) days of the occurrence, setting forth the facts and circumstances. The Executive Board shall review the facts and then submit their findings to the District for any District 36 action, in the event the allegation is serious enough, AMA may be notified for action and possible suspension of individual AMA membership cards or Organization Charter.

ARTICLE XXIV

Each AMA chartered Organization shall have an AMA Sanction, approved by The District, for all Road Rider Motorcycle events.

ARTICLE XXV Each Organization sanctioning an AMA event (except charitable events) shall forward fifty cents (.50) for each entry to The District. Said charge will be forwarded with the Referee Report to the Social Secretary upon completion of the event. This charge is limited to a cap of one thousand (1000) entries or two hundred and fifty dollars ($250.00). Any revenue re- turned to The District from the AMA as a result of sanctions will be deposited in the treasury for operating expenses.

ARTICLE XXVI Each member Organization, and elected and appointed officers shall receive, and be requested to retain, a copy of the Bylaws of District 36. These Bylaws may be amended by additions, deletions, or substitutions submitted in writing, at a regular meeting, and acted upon at the following meeting. No such amendment shall in any way supersede or contradict the Bylaws of the parent body, the American Motorcyclist Association. A two-thirds vote (2/3) of the Delegates

present shall be required to pass an amendment for a two month trial period, after which another two-thirds vote shall be required for final acceptance.

NOVEMBER 2022 Members voted to adopt and approve Bylaws on a trial basis. January 21, 2023 Bylaws passed by 2/3 members present for final acceptance.

SUPPLEMENT TO THE BY-LAWS

District 36 established four types of awards to be presented annually at an awards ceremony. These awards are available to District 36 member clubs and any individual who is a CURRENT AMA MEMBER within District 36.

1. JOE MORGAN MEMORIAL AWARD (Est. 1994) This award is presented for outstanding, meritorious service and dedication to District 36.

2. TOP CLUB AWARDS (Est. 1975) District 36 member clubs earn points by participating in events held by District 36 and other member clubs and for sponsoring events which are sanctioned by AMA. Three top scoring clubs are presented awards.

3. CHAMPIONSHIP AWARDS (Est. 1975) Riders and passengers may earn championship points by attending an event and riding a prescribed course on a motorcycle. They may also earn championship points by attending District meetings, Annual Awards Ceremonies, or by working at an event without regard to mode of transportation. Six top scoring riders and passengers, with 50% or more in championship points, are presented awards.

4. TRAVELER'S AWARD (Est. 1975) Commonly referred to as SUPPORT- ING POINTS. Riders and passengers may earn points by supporting District 36 member clubs and road events. Points may be earned by mailing donation fees or by attending the event and signing in with donation fees. There is no requirement to ride a motorcycle or com- plete the prescribed course.

In order to be eligible for points toward the Traveler's support checks must be a minimum of 50% of the cost of the event registration fee. Monies received of lesser value are appreciated and will be considered a donation.

Those who drive the course in an auto are not eligible for event awards. All who earn 50% or more of the TOTAL POINTS on the District run calendar will receive awards.

TRAVELER’S AWARDS CONT’D.

1. ALL POINTS ARE ACCUMULATED FROM JANUARY 1 TO DECEMBER 31 EACH YEAR.

2. ONLY CHAMPIONSHIP POINTS QUALIFY FOR CHAMPIONSHIP AWARDS.

3. BOTH CHAMPIONSHIP AND SUPPORTING POINTS QUALIFY FOR TRAVELER'S AWARDS.

JOE MORGAN MEMORIAL AWARD 1. This award shall be given only once to any candidate. 2. The recipient shall be a CURRENT AMA MEMBER of District 36. 3. No President shall be eligible during his or her term of office. 4. Nominations shall be made in writing, including reasons to support The nomination, by any current AMA member of District 36. The Nomination letter shall include the .name and AMA number of both the nominee and the person submitting the nomination. 5. The E-Board, in a regular Board meeting, shall discuss and weigh the merits of each person so nominated, based on the contribution and length of service to District 36. If a nominee is present at the E-Board meeting, they and any family members may be requested to leave the meeting during consideration of their nomination. 6. The E. Board shall select one or more nominees to present to the clubs vote in a regular Delegates meeting. 7. The President shall count the votes, witnessed by a District 36 Club Delegate. The witness Delegate shall not be from the same club or household as the President and not from the same household as the nominees for which the votes are being counted. 8. The President, at his or her discretion, may or may not inform the E-Board.

STEFFENSEN AWARD (Est. 2016) recipients of this award must have served the district for more over 30 years of continuous service. PRESIDENTS AWARD (Est. 2016) The President has the authority to annually award a special PRESIDENTS AWARD to any member they feel is deserving.

TOP CLUB AWARDS

1. Clubs must have a current AMA Charter.

2. Points are awarded at road events, for Participation and Man-Miles, to the clubs with the most members present or the most man-miles from the club meeting location.

3. A club may not earn both PARTICIPATION and MAN-MILES points at an event.

4. A minimum of six club members is required to compete. All club members counted must hold current AMA cards and may be asked to present a club membership card.

5. The District will present awards to the three top scoring clubs.

6. BEST EVENT AWARD (no pts) For a club to win this award all aspects of the event must be evaluated and considered exceptional The event must be well organized, the route directions must be are easy to follow. The route should also be both safe and scenic, while giving thought to the welfare and enjoyment of the members (i. e .frequent stops for facilities, checkpoints on right side of the road, etc.).

CLUBS MAY EARN POINTS FOR THE FOLLOWING

a. Delegate meeting attendance. (2.5 points per 5 point max)

b. Top Club Participation at District 36 road event. (10 points)

c. Top Club Man-Miles at a District 36 road event. (5 points)

d. Sponsoring a charitable road event (25 points)

e. Sponsoring other road events. (10 points)

f. Hosting a District 36 sponsored event. (10 points) Gypsy Tour, Turkey Run, etc.

g. Competing as a club in dress judging contests. (5 points)

h. Winning Best Dressed Club Award

i. Timely transmittal of Referee report and sign-ins to Social Secretary. (5 points).

CHAMPIONSHIP AWARDS

1. Individuals must hold a current AMA membership card. 2. They must attend the event, sign-in and complete the run course, on a motorcycle, and finish by the cut-off time. 3. Persons who ride at an event shall also earn championship points. 4. No one may use an AMA membership card that is not their own.

CHAMPION POINTS MAY BE EARNED FOR THE FOLLOWING: a. District meeting attendance. (5 points) b. One day road event. (5 points) c. Two day road event. (10 points) d. Charitable event. (5 additional points) e. District sponsored event. (10 Points) Annual Awards, Turkey Run etc. f. District Tour or Rally. (25 points) Gypsy Tour, Hey-Dey Rally etc. g. Grand Tour. (15 points) h. Competing in Dress Judging, Motorcycle Judging. (5 points) i Winning Dress Judging, Motorcycle Judging competition, 5 j. Competing in bike games or field events. (5 points). k. Winning bike games or field event competition (5 points)

TRAVELER'S AWARDS

1. These points are commonly referred to as SUPPORTING POINTS. 2. Individuals must hold a current AMA membership card. 3. Individuals earn points by paying the donation fee, whether attending the event or not. Meetings have no donation fees, thus attendance is required. 4. This includes all ROAD RIDING events with a point value.

REFER TO EVENTS LISTED UNDER CHAMPIONSHIP AWARDS

Requirements for motorcycle and dress judging are contained in the AMA National Rulebook. District 36 has modified slightly the motorcycle judging classification in recognition of the trend to greatly modify fee factory equipped motorcycles. Information sheets are available at the sign-in at those events that have scheduled and advertised these contests. Everyone is welcome to participate and win awards in these contests, however, only AMA members may earn Championship Points.

The Supplement to the Bylaws may be amended, by additions, deletions or substitutions, submitted in writing, at a regular meeting, and acted upon at the following meeting. A two-thirds vote of the Delegates present shall be required to pass an amendment for a two month trial period, after which another two-thirds vote shall be required for final acceptance.

This supplement to the Bylaws was adopted and approved by 2/3 members present in November, 2018. A passing vote was taken January 2019 for final acceptance
